This Privacy Policy («Privacy Policy») explains and presents the basis on which newhome.ch AG («we», «us», «our» or «newhome») collects personal data when you visit our website www.newhome.ch («website»), use the newhome app («app»), purchase our products and services, interact with us under a contract, communicate with us or otherwise deal with us, how we use this data, under which conditions we share it with third parties and what measures we take to protect you. In addition, we can inform you separately about the processing of your data, e.g. in declarations of consent, terms and conditions, additional privacy policies, forms and other information. The term «data» is used here synonymously for «individual data» and «personal data».

If you provide us with information about yourself or others, you must ensure that such data is accurate. In addition, you must ensure that the other persons about whom you provide us with information understand how their data is used, that they have given their consent and that they allow us and our service providers to use their data. This Privacy Policy is designed to comply with the requirements of the EU General Data Protection Regulation («GDPR») and the Swiss Data Protection Act («DSG»). However, whether and to what extent these laws apply depends on the individual case.

1 Who is responsible for processing your data?

newhome.ch AG, Talacker 41, CH-8001 Zurich is responsible for the processing of your data under this Privacy Policy («controller»), unless we inform you otherwise in individual cases.

2 How do we collect your data?

We mainly collect your data directly from you. In exceptional cases, we receive it from third parties, e.g. our service providers or contractual partners, or from publicly available sources.

3 Purpose and legal basis of data processing

We process your data when you visit our website, use our app, purchase our products and services, interact with us under a contract, communicate with us or otherwise deal with us.

In principle, we process your data in particular for the following purposes:

  • contract fulfilment and performance;
  • product/service improvement and innovation;
  • communication and customer care;
  • marketing and relationship management;
  • security and the fight against fraud and abuse;
  • risk management, governance and business development;
  • compliance with the law.

Below, you will find a detailed overview of the individual data processing operations, their purpose and any necessary legal basis.

3.1 Use of our website/app

When you visit our website or app, the technology we use automatically collects general technical data in what are known as log files. The collection of such data is necessary to enable the use and functionality of our website or app, to ensure the security and stability of our systems, to analyse the use of our products and services and to promote the further development of our products and services (see also clause 3.4) as well as for internal statistical purposes. Our legitimate interest in data processing is also in this regard.

Data collected include, but are not limited to: IP address; information about your end device’s browser and operating system; referrer URL; date and time of the server request; websites accessed; etc.

3.2 Registration of a user account

Some of our products and services, the access-protected area and the processing of requests and the administration of subscriptions require registration and the creation of a user account. We process your data collected in this context for the processing and administration of our products and services, for the verification of the data entered and for the proper invoicing of paid products and services. Accordingly, processing of this data takes place for the fulfilment or performance of the contract. 

Data collected include, but are not limited to: Title, surname; first name; address; email address; telephone number; password; time of registration; confirmation of registration, language preferences; etc.

You can check the details you provide at any time in your user account and correct it as necessary. By confirming the completion of the registration and adjusting your data in the user account, you guarantee the correctness of the content of the data you provide.

To increase security, you also have the option of using 2-factor authentication in your user account. To do this, you can install the Microsoft Authenticator app or the Google Authenticator app. Please note that this service is offered by Microsoft or Google and the terms of use and privacy policy of Microsoft or Google apply in this respect. 3.3 Products and services

We offer various products and services for seekers (e.g. search subscription, watch list, affordability check) and for advertisers (e.g. publication of advertisements, promotions for advertisements, real estate recordings, advertisements booster, advertisements interface, advertisements integration, provider directory, banner advertisements). The use of certain products and services requires a user account (see clause 3.2); no user account is required for other products and services (e.g. searching for advertisements, contacting advertisers, creating watch lists and search subscriptions). We process your data collected in this context in order to provide our products and services to you and to conclude, perform and manage the relevant contracts with you. Data processing is carried out in order to fulfil or perform the contract.

Data collected include, but are not limited to: Your contact details (e.g. first and last name, address, telephone number, email); other information provided by you (e.g. payment information relating to paid products or services, other than credit card information); information on the products and services subscribed to and used; information on the conclusion, fulfilment and management of the contracts; information on defects, complaints and changes to the contract; etc.

3.4 Analysis and marketing

If and to the extent that you give us your consent when you visit our website or app, we will use your data to further develop our products and services, our website, our app and other platforms on which we operate and to expand our offering. We and selected third parties may also use your data to show you personalised content or advertising. You can object to these data processing operations at any time or withdraw your consent, see clause 10below.

The data collected includes data in accordance with clause 3.1 and clause 6.1.

To analyse their usage behaviour, we use the tools listed in clause 6.2 and in our Cookie Consent Management.

3.5 Communication and contact forms

If you contact us via online contact form, chat, email, telephone, letter or any other means, we collect the information exchanged between you and us. We process this data in order to communicate with you and to offer you our services, in particular to respond to your requests or to respond to your wishes and ideas. The data processing is based, where necessary, on the legal basis of the fulfilment or initiation of the contract.

Data collected include, but are not limited to: subject matter of contact; company name; title; first name; surname; address; email address; telephone number; access details; manner, place and time of communication; content of communication; attached attachments; etc.

3.6 Participation in prize draws, competitions or other events

We offer various events on the subject of renting, buying, moving and living as well as various prize draws and/or competitions in which you can participate voluntarily (hereinafter referred to as «events»). We collect this data from you in order to organize and carry out the events. At the events, photos and videos can be taken on site, these recordings are used exclusively for our own purposes (e.g. posting on our website or social media, flyers, newsletters, etc.). For this purpose, our legitimate interest is also in data processing.

Data collected include, but are not limited to: surname; first name; address; email address; telephone number; if applicable, also photos, videos and/or audio recordings (to the extent permitted by law); etc.

3.7 Customer surveys, interviews and market research

If you voluntarily participate in a customer survey, interview or other market research activity from us, we collect data from you in order to further develop and improve our products and services. Our legitimate interest in data processing is also in this regard.

Data collected include, but are not limited to: surname; first name; email address, satisfaction comments; etc.

3.8 Customer opinions

We offer you the opportunity to publish your opinion on our products and services on our website and in our app. We collect your data in this context in order to provide you with this function and to ensure its proper functioning. Our legitimate interest in data processing is also in this regard.

Data collected include: name; first name; role and function; company name; image; content of customer opinion.

3.9 Comments from you

We publish articles about renting, buying, moving and living on our website, our app and social media. In this context, we offer you the opportunity to comment on our contributions. The data collected by you in this context is collected by us in order to ensure the proper functioning of the commentary function.

Data collected include, but are not limited to: name; first name; email address; content of comment.

3.10 Newsletters

When you subscribe to our newsletter, we process the data you provide (e.g. contact details) in order to send you newsletters. The data processing is based on your consent. You can unsubscribe from our newsletter by using the unsubscribe option included in the newsletter or by sending us an email to the above address. If you have a user account, you can also unsubscribe from our newsletter at any time via the advanced settings in your user account.

Data collected include, but are not limited to: Title; first name; last name; email address; postcode; confirmation of registration.

3.11 Personalised recommendations

When you create a user account on our website or in our app, we automatically send you messages and recommendations about our products and services as well as services of our partners based on the data collected relating to you, your user behaviour or your advertisement. You can unsubscribe from the personalised recommendations at any time using the link (www.newhome.ch/blog/de/mailings-unsubscribe/), the unsubscribe option included in the mailings, or by sending an email to the above address. You can also unsubscribe from personalised recommendations at any time via the advanced settings in your user account.

Data collected include, but are not limited to: Your contact details; your search criteria; advertisements visited; recorded advertisements, etc.

3.12 Applications

We publish our vacancies on our website. We process your data as part of the application process to respond to your making contact, to review your profile and to prepare for and process the future employment relationship and, if necessary, to take your application into consideration for future positions, if you agree that we keep your personal data for possible future vacancies even longer. The data will be processed on the legal basis of the contract initiation.

Data collected include, but are not limited to: Contact details and personal details (e.g. name, address, email address, telephone number, date of birth, nationality/citizenship); information from your application form (e.g. motivation, advertised position, work quota, etc.); application documents (e.g. CV, information on former employers, references and employment certificates, data on professional experience, details of training and further qualifications); etc.

3.13 Security and fraud and abuse prevention

We process your data to protect our IT and other infrastructure. For example, we process data to monitor, analyse and audit our networks and IT infrastructures, including access controls. Data processing is performed on the basis of our legitimate interest and our legal obligations.

3.14 Compliance with laws and legal procedures

We process your data to comply with legal regulations (e.g. to comply with tax obligations, to combat fraud, etc.). In order to comply with legal and regulatory requirements, we may need to request further information from you. We may also process your data to enforce legal claims and to support our defence in litigation and official proceedings. Data processing is performed on the basis of our legitimate interest and our legal obligations.

3.15 Risk management, governance and business development

We process your data as part of our risk management and corporate governance. We also process your data to protect us from criminal or abusive activities. As part of our business development, we may sell to or acquire from others businesses, parts of businesses or a companies, or enter into partnerships, which may result in the exchange and processing of data based on your consent. Our legitimate interest in data processing is also in this regard.

4 Profiling and automated decision-making

We may automatically evaluate certain of your personal characteristics on the basis of your data («profiling») for the purposes stated in clause 3, if we want to identify preference data, but also to identify abuse and security risks, to carry out statistical evaluations or for operational planning purposes. For the same purposes, we may also create profiles, i.e. we may combine the data collected from you to better understand you as a person with your various interests and other characteristics or to assess your creditworthiness. We do not use profiling that may have a legal impact on you or similarly significantly affect you without human review.

In certain situations, for reasons of efficiency and consistency of decision-making processes, it may be necessary for us to automate discretionary decisions affecting you with legal effects or potentially significant disadvantages («automated individual decisions»). In this case, we will inform you accordingly and provide for the measures required by applicable law.

5 Disclosure of data to third parties

In connection with our products, services and business activities, we cooperate with other companies or persons («third parties») or engage third parties to process data in accordance with this Privacy Policy and for the purposes stated in this Privacy Policy. We reserve the right to pass on data to third parties due to mandatory legal obligations.

In particular, we may share your data with the following categories of third parties:

  • Providers, advertisers and inspectors

If you would like to contact a provider/advertiser via our contact form «Contact the vendor», we will pass on your request and the information you provide directly to the respective provider/advertiser or inspection officer.

  • Banks

If you request financing advice via our website, the respective bank will receive your data collected in this connection. The bank is solely responsible for the financing advice and the associated data processing. Further information on their data processing can be found in the privacy policy of the respective bank.

  • Third party offers
  • Our website or app may contain other third party offers. If you click on such an offer, we will transfer data to the required extent to the respective provider (e.g. the information that you found this offer with us and any further information that you have provided on our website or app for this purpose). The respective provider is solely responsible for the data processed in this context.   • Service providers
  • We work with service providers in Germany and abroad who, on our behalf or under joint responsibility, process data about you or receive data about you from us at their own responsibility (e.g. IT providers, shipping companies, advertising service providers, login service providers, banks, insurance companies, telecommunications companies, credit reference agencies, providers of address checks, lawyers, etc.) or who we use to process personal data for one of the purposes mentioned above on our behalf and only in accordance with our instructions.
  • Contractual partner including customers
  • If required by the respective contract, we will pass on your data to other contractual partners.
  • Acquirers of business units

In the event of a sale, merger or other reorganization of business units, assets or other parts of newhome, we may share your data with acquirers or interested parties.

  • Authorities

We may share your data with courts and authorities in Switzerland or other countries if we are legally obliged or entitled to do so or if this is deemed necessary to protect our interests. The courts and authorities are responsible for the processing of data about you that they receive from us.

6 Use of cookies, tools, plug-ins, third-party platforms

6.1 Cookies

We use cookies on our website and in our app and assign a unique identification number (an ID) to your end device, which allows us to identify your browser or device and which can enable certain third-party providers (e.g. Ringier Advertising AG) to do the same. Cookies are small files that your browser automatically creates and that are stored on your device (laptop, tablet, smartphone, etc.) when you visit our website or use our app.

Some cookies are necessary for the functioning of our website and app or for certain functions. These cookies are only temporary («session cookies») and are automatically deleted after you have visited our website or used our app. Other cookies are necessary to store user configurations and other information beyond a session («permanent cookies»). Nevertheless, you have the option of setting your browser so that it rejects cookies, saves them only for a single session or deletes them before their usual expiration date.

6.2 Tools

On our website and in our app, we use various tools to evaluate the use of our products and services and to design and optimise our website and app according to requirements (e.g. Usercentrics, Google Analytics, Facebook Remarketing, etc.). For more information on the tools actually currently used, please refer to our Cookie Consent Management Tool. You can also change your settings there at any time.

6.3 Plug-ins

We do not use plug-ins on our website. If our website contains icons from or links to other third parties (e.g. Facebook, Twitter/X, LinkedIn, Xing, WhatsApp, TikTok, Instagram, Google Street View), we only use them for passive links to the websites of the respective providers.

6.4 Third-party platforms

We operate accounts on third-party platforms (e.g. LinkedIn, Instagram, Facebook, TikTok, YouTube, Xing). If you communicate with us through our accounts or otherwise interact with our accounts on these third-party platforms, your data will also be processed in accordance with the respective platform’s privacy policy. Further information on the purpose and scope of the data collection and processing by the third-party providers can be found in the respective data protection statements.

7 Transfer of data abroad

The data we collect from you may be transferred, processed and stored in a country outside the European Economic Area (EEA) or Switzerland, in particular the USA. From the perspective of the EEA and Switzerland, the laws in some of these countries may not provide an adequate level of data protection. We will only transfer data to these countries if this is necessary to perform a contract or to assert or defend legal claims, or if such transfer is based on your express consent or is subject to guarantees ensuring the protection of your data, such as the US-EU Data Privacy Framework, the US-CH Data Privacy Framework (if and to the extent in force and applicable) and/or the EU Standard Contractual Clauses, which may have been adapted to Swiss law and be required.

8 How long do we keep your data?

We will only process your data for as long as is necessary for the fulfilment of the purposes for which we collected it, including compliance with legal retention obligations and, to the extent necessary to assert or defend legal claims, until the end of the relevant retention period or until the settlement of the relevant claims. At the end of the relevant retention period, we will securely destroy your data in accordance with applicable laws and regulations.

9 How do we protect your data?

We take appropriate organisational and technical security measures to protect your data from loss, destruction, falsification, manipulation and unauthorized access or disclosure. In doing so, we orient ourselves to the current technical standards and continuously adapt the measures to technological developments. 

However, we and your personal data may fall victim to cyberattacks, cybercrime, brute force methods, hacking and other fraudulent and malicious activities, including, but not limited to, viruses, fakes, malfunctions and interruptions that are outside our control and responsibility. We have also put in place procedures for dealing with suspected personal data breaches and will notify you and all relevant regulatory authorities of a breach if we are required to do so by law.

10 What rights do you have in relation to your data?

In connection with the processing of your data by us, you have various rights depending on the applicable data protection law: the right to access how we process which personal data about you, the right to rectification, the right to erasure, the right to restrict processing, the right to data portability, the right to revoke previously given consent for future data processing, and the right to object to a particular processing.

In addition, you have the right to lodge a complaint with the competent data protection authority if you believe that we do not process your personal data in accordance with data protection standards. In Switzerland, the competent data protection authority is the Swiss Federal Data Protection and Information Commissioner (http://www.edoeb.admin.ch). However, we ask you to contact us first if you believe that we do not process your personal data in accordance with your wishes so that we can take up your request and implement it accordingly.

If you have created a user account with us, you can view, correct or delete your data at any time via your user account. You can also request information about your data directly via your user account. If you have not created a user account with us, you can send an email to [email protected] to exercise your rights.

Please note that the aforementioned rights are subject to legal restrictions and may impair or make impossible the provision of our services.

11 Updating your data

If you change your contact details or any of the other information we hold is inaccurate or obsolete, please send us an email at the above email address. If you have a user account, you can also correct your details there at any time.

12 Changes to this Privacy Policy

Due to the continuous development of our website and app and its content, as well as due to changes in the law or regulatory requirements, we may need to amend this Privacy Policy from time to time. You can find our current Privacy Policy on our website and in our app. We therefore recommend that you read this Privacy Policy regularly so that you are always up to date on what we do with your data and how you can exercise your rights.
